If you are not eligible, or do not agree to the Terms, then please do not use the Service.

1. Eligibility

1.1 You must be at least eighteen (18) years old to use the Service. By agreeing to the Terms, you represent and warrant to us: (i) that you are at least eighteen (18) years old (ii) that you have not previously been suspended or removed from the Service and (iii) that your registration and your use of the Service is following any and all applicable laws and regulations. If you are using the Service on behalf of an entity, organization, or company (collectively "Subscribing Organization"), you are an authorized representative of that Subscribing Organization with the authority to bind such organization to these Terms; and agree to be bound by these Terms on behalf of such Subscribing Organization. In such a case, “you” in these Terms refers to your Subscribing Organization, and any individual authorized to use the Service on behalf of the Subscribing Organization, including you.

2. Privacy Policy; End User License Agreement; Additional Terms

2.1. Privacy Policy. Please read the Mozio Privacy Policy carefully for information relating to our collection, use, and disclosure of your personal information. The Mozio Privacy Policy is hereby incorporated by reference into, and made a part of, these Terms.

2.2. Additional Terms. Your use of the Service is subject to any additional terms, rules, or guidelines applicable to certain services and features which we may post from time to time (the "Additional Terms"). All such Additional Terms are hereby incorporated by reference into, and made a part of, the Terms.

3. Modi?cation of the Terms

3.1. We reserve the right, at our discretion, to change the Terms on a going forward basis at any time. Please check the Terms periodically for changes. Your continued use of the Service after the changes become effective constitutes your binding acceptance of such changes. In the event that a change to the Terms materially modi?es your rights or obligations, we will make an effort to notify you of the change, such as by sending you an email to the address we have on ?le for you, Immaterial modi?cations are effective upon publication, and material changes will be effective upon the earlier of (a) continued use of the Service with actual knowledge of the modi?cation, or (b) thirty (30) days following the change. For the avoidance of doubt, disputes arising hereunder will be resolved in accordance with the Terms in effect that the time the dispute arose.

4. Dispute Resolution and Arbitration

4.1 Generally. In the interest of resolving disputes between you and Mozio in the most expedient and cost-effective manner, you and Mozio agree that any and all disputes arising in connection with these Terms of the Service shall be resolved by binding arbitration. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. Our agreement to arbitrate disputes includes but is not limited to all claims arising out of or relating to any aspect of these Terms, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory, and regardless of whether the claims arise during or after the termination of these Terms. You understand and agree that, by entering these Terms, you and Mozio are each waiving the right to a trial by jury or to participate in a class action

5. Exceptions

5.1. Notwithstanding subsection (15.1, we both agree that nothing herein shall be deemed to waive, preclude, or otherwise limit either of our right to (i) bring an individual action in small claims court, (ii) pursue enforcement actions through applicable federal, state, or local agencies where such actions are available, (iii) seek injunctive relief in a court of law, or (iv) to ?le suit in a court of law to address intellectual property infringement claims.

6. Arbitrator

Any arbitration between you and Mozio will be governed by the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modi?ed by these Terms, and will be administered by the AAA. The AAA Rules and ?ling forms are available online at, by calling the AAA at 1-800-778-7879, or by contacting Mozio.

7. Notice; Process

7.1. A party who intends to seek arbitration must ?rst send a written notice of the dispute to the other, by certi?ed mail, Federal Express (signature required), or in the event that we do not have a physical address on ?le for you, we may send notice to you by electronic mail ("Notice"). Mozio's address for Notice is: [Mozio, Inc., 139 Townsend St., Suite 150, San Francisco, CA, 94115]. The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the speci?c relief sought ("Demand"). We agree to use good faith efforts to resolve the claim directly, but if we do not reach an agreement to do so within 30 days after the Notice is received, you or Mozio may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by you or Mozio shall not be disclosed to the arbitrator until after the arbitrator makes a ?nal decision and award, if any; provided that if our dispute is ?nally resolved through arbitration in your favour, Mozio shall pay you the greater of (i) the amount awarded by the arbitrator, if any, and (ii) the greatest amount offered by Mozio in settlement of the dispute prior to the arbitrator’s award.

8. Fees

8.1. Any arbitration hearings will take place at a location to be agreed upon in San Francisco, CA, provided that if the claim is for $10,000 or less, you may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a non-appearance based telephonic hearing, or by an in- person hearing as established by the AAA Rules. If the arbitrator ?nds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA Rules. In such case, you agree to reimburse Mozio for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. Regardless of the way the arbitration is conducted, the arbitrator shall issue a reasoned written decision suf?cient to explain the essential ?ndings and conclusions on which the decision and award, if any, are based. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from either party made within 14 days of the arbitrator’s ruling on the merits.

9. No class actions

YOU AND MOZIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Mozio agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

10. Modi?cations

10.1 In the event that Mozio makes any future change to this arbitration provision (other than a change to the Mozio's address for Notice), you may reject any such change by sending us written notice within 30 days of the change to Mozio's address for Notice, in which case your account with Mozio shall be immediately terminated and this arbitration provision, as in effect immediately prior to the amendments you reject shall survive.

11. Enforceability

11.1. If only Subsection 15.6 is found to be unenforceable or the entirety of this Section 15 is found to be unenforceable, then the entirety of this Section 15 shall be null and void and, in such case, the parties agree that the exclusive jurisdiction and venue described in Section 16 shall govern any action arising out of or related to these Terms.

12. Refunds

12.1. Any refund requests must be made within 30 days of the trip date, to allow for timely investigation.

13. Governing Law; Venue

13.1. These Terms, whether interpreted in a court of law or in arbitration, shall be governed by the laws of the State of California as they apply to agreements entered and to be performed entirely within California by California residents, and without regard to con?ict of law principles. To the extent that any lawsuit or court proceeding is permitted hereunder, you and Mozio agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located within the San Francisco, California for the purpose of litigating all such claims or disputes. We operate the Service from our of?ces in California, and we make no representations that information and materials included in the Service are appropriate or available for use in other locations. Access to the Service from any territory where the content is illegal is prohibited.

16. General

16.1 The Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire and exclusive understanding and agreement between you and Mozio regarding your use of and access to the Service, and except as expressly permitted above may only be amended by a written agreement signed by authorized representatives of the parties. You may not assign or transfer the Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written

16.2. Consent We may assign the Terms at any time without notice. The failure to require performance of any provision shall not affect our right to require performance at any time thereafter, nor shall a waiver of any breach or default of the Terms constitute a waiver of any subsequent breach or default or a waiver of the provision itself. Use of paragraph headers in the Terms is for convenience only and shall not have any impact on the interpretation of particular provisions. In the event that any part of the Terms is held to be invalid or unenforceable, the unenforceable part shall be given effect to the greatest extent possible and the remaining parts will remain in full force and effect. Upon termination of the Terms, any provision which, by its nature or express terms should survive, will survive such termination or expiration.

16.3. Most of our vehicles will allow you to bring a foldable wheelchair. Please make sure you consider the amount of luggage you'll bring since the foldable wheelchair will take up space in the trunk of the vehicle. Please let us know you'll be bringing a foldable wheelchair on the Special Instructions right before you confirm your booking.

16.4. While we attempt to cover all your needs, not all of our vehicles are wheelchair accessible. We show a picture of the vehicle with a ramp whenever a wheelchair accessible vehicle is available. Please make sure you specify you'll require a wheelchair accessible vehicle on the Special Instructions right before you confirm your booking.

16.5. Making a change to a reservation is simple but will depend on a series of conditions. Mainly that your reservation is within the cancellation policy and that the provider you selected can accommodate the changes you're requiring. Please note, changes may have additional charges since prices are subject to change. Make sure you request your change as soon as possible for us to be able to assist you. If your request is not cancellable, it will depend on how far in advance you notify us or the local provider about your change request. Remember, if your request is still within the cancellation cut-off, you could simply cancel your existing reservation and rebook it with the correct details

16.6. Private rides may be able to accommodate an additional stop on the way to your final destination as long as you request it with enough time for the local provider to be able to plan accordingly. Please make sure you specify you will need to make a stop along your route on the Special Instructions field right before you confirm your booking.

16.7. Please bear in mind, additional charges may apply. Since you share with other passengers, shared rides do not often allow for additional stops

16.8. To make things easy for you, we provide a recommended pickup time. Typically, we recommend 30-40 minutes if you have luggage, though if you have only a carry-on 20 minutes may be enough. If you're flying internationally, we recommend adding another 30 minutes for getting through customs.

16.9. We also recommend calling the provider once you land to inform them that you have arrived, so they know to expect you soon.

16.10. We know that sometimes your plans change, so we've tried to make it easy for you to cancel, in case you need to. As long as it's before the provider's cancellation cut-off (differs by provider, usually 24 hours or less), you can just click on the cancellation link in your confirmation email.

16.11. You can request a child seat on the special instructions right before confirming your booking. Please specify the age and size of the child. The provider will see your special request and confirm whether they can provide a child seat/booster seat. Additional charges may apply.

16.12. If you did not request your child seat before confirming the booking, please send us an email specifying your confirmation number, age and size of the child, and copy the provider on it for faster service. You can find the local provider's email address on your confirmation email.

16.13. A confirmation email is sent to the email address you specified when confirming your booking. If it's not on the inbox, please check the spam or junk mail folders as sometimes it gets filtered by your email provider. Please make sure you mark us as a trusted email address since we may need to send you more communication regarding your reservation. 16.14. We recommend you arrive at the airport 2 hours in advance. Bear in mind, different airlines have different requisites for your presence at the airport depending on the time it will take for you to clear security and baggage drop-off.

16.15. If your flight is delayed, and as long as your flight number has not changed from you what you originally informed us, all our private transport providers and many of our shared ride providers will monitor flight status, so whenever your flight lands, they'll be there to pick you up.

16.16. We vet all our providers thoroughly and aim to work with reliable companies only. We perform regular compliance checks and review our working relationship with providers to ensure they adhere to our quality standards.

16.17. All providers booked through Mozio have the following minimal requirements

i) 1M in automotive insurance

ii) Obligatory background checks for all drivers

iii) Annual maintenance of all cars

16.18. The price shown is the total price for your search. If you entered more than one passenger, then it will calculate the price for the total number of passengers. If you selected "Roundtrip”, it will calculate the amount for both arrival and departure trips. Bear in mind the currency you'll be charged in will be specified on the upper right-hand corner of the webpage

16.19. A Private Van is usually a van for 7-11 people that will transport you and your friends between one location and the airport.

16.20. A Shared-ride shuttle is a shuttle that stops at an average 2-4 locations. You could be the first dropped off or picked up, or possibly the last. Usually, shared ride shuttles offer a substantially reduced fare vs. private transfer options but take slightly longer. Please note, a Shared ride may take up to 45 minutes to arrive to pick you up at the airport or 20 minutes for a trip to the airport.

16.21. Anything that needs to be stowed away in the trunk of the vehicle will be considered luggage. We consider carry-on only what you can take in your lap inside the vehicle. If you have any oversized item (such as a bike box, stroller, or foldable wheelchair, etc.) it will be counted as 2 pieces of luggage. The maximum amount of luggage is displayed next to the suitcase icon for each option available. Please take that into account when selecting the vehicle.

16.22. Please note, a standard large bag is 62 linear (total) inches (157.48 cm) or 27" x 21" x 14” (68.58cm x 53.34cm x 35.56cm) and 50 pounds (22.68kg). This is based on the standard most airlines use for checked bags.

16.23. Free Waiting Time is the time the driver will wait for you if you're delayed during migrations, baggage claim, or customs. If you experience a delay and require additional waiting time, you may contact the local provider and ask them to wait a little longer until you can meet the driver.
